The Website

The Website is a tool to facilitate surveyors, engineers and the like (Members) to promote their services to Clients. Members provide information about themselves, their services and their fees (Members Information) which is stored on the Website.  Selected parts of Members' Information may be displayed on the Website and emailed to you in response to your enquires so that you can contact them.  Members will be informed by email whenever any of their information is displayed and/or emailed to you, along with your details so that they can contact you.  We are not involved in any discussions, negotiations or agreements between Members and Clients.

Member's Information

We do not review or check the accuracy or legality of Member's Information.  You are responsible for checking that any Member's Information which you may rely upon is correct.  In particular before placing an order with a member it is your responsibility to ensure that the member has satisfactory qualifications, accreditations, experience and insurance suitable for your requirement.

In the event that any incorrect or misleading Member's Information comes to your attention you must inform us immediately, by email, so that we can request the Member to correct or remove it.

Member's Services and Estimates

Members must only offer to carry out work for which they are sufficiently knowledgeable, experienced, competent and able to carry out, taking into account all relevant factors, including the type of work, the age and type of the property concerned, and its geographical location (Services).  The offer of a Service or the provision of an estimate (Estimate) for a Service through the Website is based on limited information and does not constitute a contract or binding offer.

Nothing in this agreement shall limit or exclude our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence. Subject to this, we will not be held liable for any loss or damages arising out of this agreement or the operation or non operation of the Website.

Governing Law

This agreement shall be governed by and construed in accordance with English law. If any provisions of this agreement are held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain.

Landlords and Legionella

As a Landlord you have a responsibility to understand and minimise the risks from Legionella in your properties. This means complying the relevant section (in chapter 3) of the Health and Safety at Work Act 1974. The Health and Safety Executive clearly states that if you are ‘someone in control of premises, including landlords, you must understand the health risks associated with legionella.’

The Approved Code of Practice: Legionnaires’ disease: The control of Legionella bacteria in water systems (L8) contains guidance on how to manage and control the risks in your system and can be found on the HSE website.

Landlords have a legal responsibility to ensure a risk assessment of the property is carried out by a competent person who has knowledge of Legionella and water systems and is up to date with the latest legislative changes. Following the findings of the report it is the Landlord’s responsibility to manage any risks, prevent or control any risks, keep and maintain correct records and carry out any other associated duties. It is the Landlord’s responsibility to know what to do to comply with the law and to take suitable precautions.

Who is competent to carry out a risk assessment?

The Assessor must have an understanding of your water systems, the equipment associated with it such as pumps, heat exchangers, showers etc, and their constituent parts. They should be able to identify whether they are likely to create a risk from exposure to legionella, and whether:

  • The water temperature in all or some parts of the system is between 20–45 °C,
  • Water is stored or re-circulated as part of your system,
  • There are sources of nutrients such as rust, sludge, scale, organic matter and biofilms,
  • The conditions are likely to encourage bacteria to multiply,
  • It is possible for water droplets to be produced and, if so, whether they can be dispersed over a wide area, e.g. showers and aerosols,
  • It is likely that any of your, residents and visitors are more susceptible to infection due to age, illness, a weakened immune system etc. and whether they could be exposed to any contaminated water droplets

What does an assessment include?

An assessment will include; the name and competencies of the person responsible for the assessment and of the person managing the system, a description of the system, identify potential risks, identify any means of preventing the risk or recommendations to control risks, suggestions for monitoring results, checks and frequency of testing.

What is Legionnella?

Legionellosis is a collective term for diseases caused by legionella bacteria including the most serious Legionnaires’ disease, as well as the similar but less serious conditions of Pontiac fever and Lochgoilhead fever. Legionnaires’ disease is a potentially fatal form of pneumonia and everyone is susceptible to infection. It is easy for bacteria to grow if conditions are right so it is therefore important to control the risks by introducing appropriate measures outlined in in the Government Guidance mentioned earlier
