The Website

The Website is a tool to facilitate surveyors, engineers and the like (Members) to promote their services to Clients. Members provide information about themselves, their services and their fees (Members Information) which is stored on the Website.  Selected parts of Members' Information may be displayed on the Website and emailed to you in response to your enquires so that you can contact them.  Members will be informed by email whenever any of their information is displayed and/or emailed to you, along with your details so that they can contact you.  We are not involved in any discussions, negotiations or agreements between Members and Clients.

Member's Information

We do not review or check the accuracy or legality of Member's Information.  You are responsible for checking that any Member's Information which you may rely upon is correct.  In particular before placing an order with a member it is your responsibility to ensure that the member has satisfactory qualifications, accreditations, experience and insurance suitable for your requirement.

In the event that any incorrect or misleading Member's Information comes to your attention you must inform us immediately, by email, so that we can request the Member to correct or remove it.

Member's Services and Estimates

Members must only offer to carry out work for which they are sufficiently knowledgeable, experienced, competent and able to carry out, taking into account all relevant factors, including the type of work, the age and type of the property concerned, and its geographical location (Services).  The offer of a Service or the provision of an estimate (Estimate) for a Service through the Website is based on limited information and does not constitute a contract or binding offer.

Client Information

Any information which you provide about yourself to the Website is known as Client Information, and you warrant that this is genuine and correct.  You agree that any Client Information may be passed to Members to allow them to promote their Services to you.  Client Information will be treated with full confidentiality and will not be passed to any other third party.

What is lease enfranchisement?

Enfranchisement is the right to purchase the freehold of your leased property.  The right of long leaseholders to buy their landlord’s interest outright or acquire an extended lease term, is unique to England and Wales.  If your leased property is a house, lease enfranchisement is an individual right to purchase the freehold of that house.  If your leased property is a flat, the right is to buy the freehold together with the leaseholders of the other flats.  This is called ‘collective enfranchisement’ and the result is that you will own a share of the freehold together with the other leaseholders.

Why would I want to purchase the freehold of my leased property?

If you purchase the freehold you will own your home and this could increase the value of your property and give you more control over its management, including repairs and alterations.

Do I qualify for lease enfranchisement?

To qualify for lease enfranchisement you must be a qualifying tenant and your property must be a qualifying building.  To be a qualifying tenant you must have a long lease of your property (typically one that exceeded 21 years when originally granted).  If your leased property is a house, your lease must cover the entire house and you must have held it for the last 2 years.  If your leased property is a flat, the building must contain 2 or more flats, at least two thirds of the flats must be occupied by qualifying tenants and no more than 25% of the building being used for non-residential purposes.

The detailed conditions for qualification, as well some important exclusions and procedural requirements are set out in law.  The relevant legislation is extremely complex and lengthy and it is advisable to seek professional advice before starting the process.
